All trading within our programs occurs in a simulated environment using virtual funds.

2. Acknowledgment of Risk
Trading financial instruments involves significant risk of loss, even in a simulated environment. Our programs are designed for educational evaluation and are not suitable for everyone. Past performance in a simulation is not indicative of future results and does not guarantee future income or success in live trading.

3. User Eligibility
To use our services, you must:

• Be at least 18 years of age.

• Reside in a jurisdiction where our services are legally permitted.

• Use a payment method registered in your own name. Accounts funded by third-party payments will be suspended or terminated.

4. Evaluation & Funding Program Rules
By purchasing an evaluation or program, you agree to adhere to all specified rules, including but not limited to maximum drawdown limits, profit targets, restricted trading strategies, and time constraints. Violation of these rules may result in disqualification from profit splits or account termination.

5. Refund Policy
All fees for evaluations and program access are final and non-refundable . Fees are paid for access to our proprietary evaluation platform, tools, and the opportunity to qualify for a Qualified account, not for a guaranteed outcome or profit.

6. Performance Fee
Successfully completing an evaluation phase qualifies you for a simulated funded account and potential profit splits. All payout requests are subject to review and approval by our Risk & Compliance team. Payouts may be declined due to suspected rule violations, discrepancies in personal information (KYC), or the use of prohibited trading strategies. Valid government-issued identification is mandatory for all payouts.

7. Acceptable Conduct
You agree to interact with Ace Up Capital staff and other users respectfully. We strictly prohibit:

• Abusive, threatening, or harassing communication.

• Spamming, platform manipulation, or uploading false data.

• The use of unauthorized trade-copying or automation tools to exploit the platform.

8. Prohibited Activities
You must not:

• Use our services for any unlawful purpose.

• Attempt to hack, reverse-engineer, or circumvent any platform security or rule mechanisms.

• Use VPNs or other methods to disguise your location or identity in violation of our eligibility requirements.

• Copy, resell, or misuse any part of our platform without express written permission.

• Participate if you are an employee, owner, or affiliate of a competing proprietary trading firm.

9. Payment Disputes & Chargebacks
Filing a fraudulent credit card chargeback or payment dispute without first contacting our support team to resolve the issue is a material breach of this agreement. Initiating such a dispute will result in the permanent ban of all associated accounts, forfeiture of any earned profits or balances, and may lead to legal action to recover losses.

10. Complaints & Account Appeals
To appeal an account decision or file a formal complaint, please contact support@aceupcapital.com. Our team will review your case and provide a response within 10 business days. All review decisions are final.

11. Limitation of Liability
Our services are provided on an “as is” and “as available” basis. Ace Up Capital does not guarantee uninterrupted, secure, or error-free operation of the platform. To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use or inability to use our services.

12. Indemnification
You agree to indemnify and hold harmless Ace Up Capital Ltd, its payment agents, officers, and affiliates from any claims, liabilities, damages, and expenses (including legal fees) arising from your breach of these Terms or misuse of the platform.

13. Account Termination
We reserve the right to suspend or terminate your account immediately, without prior notice, for any breach of these Terms or upon suspicion of fraudulent or abusive activity. You remain responsible for any fees incurred prior to termination.
